Abstrak :
Women and children are the most vulnerable groups in society who tend to be
victims of prostitution. Prostitution is a form of trafficking in persons. Trafficking
in persons is a violation of human rights and includes extraordinary, organized,
and transnational crimes. This study aims to determine the prevention of
prostitution as a criminal act of trafficking in persons in Indonesia through penal
efforts and to determine the formulation of criminal sanctions against
perpetrators of criminal acts of trafficking in persons for the purpose of sexual
exploitation. This research is a normative juridical research with statutory and
conceptual approach methods and descriptive-analytical research specifications.
The results obtained from this research can be concluded that the formulation of
acts regulated in the Criminal Code and the TPPO Law have similarities in terms
of the substance of the criminal offense, namely both ensnare perpetrators who
act as intermediaries or pimps in human exploitation. However, there are
differences in the construction of the weight of criminal sanctions. The Criminal
Code provides alternative criminal sanctions, allowing judges to choose between
imprisonment or fines. Meanwhile, the TPPO Law applies cumulative sanctions,
where the perpetrators can be charged with imprisonment and fines at the same
time. The formulation of criminal sanctions against perpetrators of trafficking in
persons in the TPPO Law is formulated with a pattern of aggravating the weight
of criminal threats (stafmaat). The increase in the weight of criminal sanctions
aims to provide more optimal deterrence to perpetrators of trafficking in persons.
