Abstrak :
The ethical code for notaries establishes behavioral standards that must be
adhered to in order for notaries to act ethically and lawfully. One of the sanctions
for violating the ethical code is dismissal without honor. This research aimed to
analyze the application of ethical code sanctions against notaries who have
committed criminal acts within their duties based on legally binding judgments,
which must be initiated through complaints. It also aimed to analyze how the
sanction of dismissal without honor can be imposed on notaries who have
committed criminal acts based on legally binding judgments. Using a normative
juridical approach, the research was prescriptive in nature. Data collection
involved literature review presented in systematically arranged narrative texts
and qualitatively analyzed in a normative manner.
The findings suggest that the application of ethical code sanctions against
notaries who have committed criminal acts within their duties, based on legally
binding judgments, must be initiated through complaints. The process of applying
ethical code sanctions to a notary proven to have committed criminal acts in
performing their duties involves the Council of Honor seeking facts regarding
alleged violations of the ethical code by the notary, either upon receiving written
complaints from organization members or affected individuals, accompanied by
convincing evidence of the alleged violations. This process indicates that the
enforcement of ethical codes against notaries who commit criminal acts within
their duties still relies on complaints from aggrieved parties. The sanction of
dismissal without honor can be imposed on notaries who have committed criminal
acts based on legally binding judgments. This decision is deemed appropriate and
in accordance with the consequences outlined in the ethical code and the Notary
Law. The ethical code for notaries establishes behavioral standards, including
ethical and lawful conduct, to prevent similar violations, prioritizing the notarial
profession and public interest over individual interests, which is crucial for
maintaining the reputation of the notarial profession.
