Abstrak :
The presumption of innocence has been regulated in law, but in practice in the field in
the process of arresting hands until the initial examination contained in the BAP
(Minutes of Examination) is still not fully in accordance with the SOP (Standard
Operational Procedure) that has been set. The problem approach used for this
research is an empirical juridical approach, namely an approach carried out by legal
research conducted by obtaining and examining primary data or data obtained from
interviews. The result of this research is the application of the presumption of
innocence in the investigation process at Sidoarjo Police has not been fully optimized
because there are still SOP (Standard Operational Procedures) that are still not
applied and Factors inhibiting the implementation of the presumption of innocence in
the Sidoarjo Police, among others, are the lack of professionalism and expertise of the
police can hinder the application of the presumption of innocence. In addition, the lack
of public knowledge and the lack of a supervisory system in the investigation process.
