Abstrak :
Legal protection for children is an effort to ensure that children obtain
rights and obligations for their social, physical, and mental growth and
development. One form of this protection is diversion, which entails diverting
juvenile cases from the criminal justice process to processes outside of criminal
justice. Violence perpetrated by children as offenders still frequently occurs and
continues to be reported by victims, families, and the community. This research
aims to understand the process of implementing diversion by the Banjarnegara
District Attorney's Office and the obstacles encountered in protecting children's
rights based on Law No. 11 of 2012 concerning the Juvenile Justice System. The
research employs an empirical juridical approach with descriptive-analytical
specifications. The research is conducted at the Banjarnegara District Attorney's
Office using Purposive Sampling technique to select informants. Both primary
and secondary data sources are utilized. The research findings indicate that the
implementation of diversion efforts by the Public Prosecutor's Office for juvenile
criminal cases at the Banjarnegara District Attorney's Office is in accordance
with Law No. 11 of 2012 concerning the Juvenile Justice System. However,
obstacles are influenced by three aspects: legal factual aspects where if one party
does not agree, the diversion process cannot proceed; the Public Prosecutor's
Office's suboptimal offering of diversion to the parties involved; and legal
cultural aspects where societal perceptions still favor punishment as the most
appropriate response to criminal actions by perpetrators.
