Abstrak :
One of the complexities in insurance lies in the matter of insurance claim
payments. Life insurance claims often become subjects of complex disputes between
policyholders and insurance companies. The implementation of the principle of
utmost good faith in insurance claim disputes will be a crucial factor to ensure that
the relationship between policyholders and insurance companies can proceed fairly
and transparently. This research aims to analyze the rejection of claim payments
and policy terminations carried out by PT. AIA Financial as well as the application
of the principle of utmost good faith in disputes of life insurance claims of PT. AIA
FINANCIAL in the verdict of the South Jakarta District Court Number
16/Pdt.G/2023/PN JKT.SEL.
This study employs a normative juridical approach method with descriptive
analysis research specifications. Secondary data presented in a systematic
description form is used and then analyzed qualitatively in a normative manner.
The research findings indicate that the rejection of claim payments and
policy terminations conducted were legally appropriate. However, in the
application of the principle of utmost good faith, the panel of judges did not apply
the principle of utmost good faith in their legal considerations regarding the
violation of the principle of utmost good faith committed by the plaintiff. The panel
of judges in their legal considerations should consider the principle of utmost good
faith as stipulated in Article 251 of the Commercial Code.
