Abstrak :
Railways is one of the present land transport support community life. The main purpose of the transport Railways is to facilitate the movement of people and / or goods in bulk safely. In terms of achieving these objectives are sometimes found some unforeseen circumstances, circumstances that called the state force (coercion) that can occur due to natural disasters such as earthquakes, floods, landslides and others.
PT. Railways as carriers and railways certainly have a responsibility in that regard, although the Act No. 23 of 2007 concerning a tender Railways backfire the concept of separation of responsibilities organizing body, the body of the infrastructure and facilities. But until now it has not been realized so that the responsibility of organizing the railways still be one responsibility that is PT. Kereta Api Indonesia.
This study was prepared by using a normative juridical approach. Specifications research is descriptive research. Location of the research conducted at the University of General Sudirman Central Library, Library of the Faculty of Law UnSoed, and PT. Kereta Api Indonesia DAOP V Purwokerto. Based on the results of research and discussion, PT. Kereta Api Indonesia DAOP V Purwokerto showed that the responsibilities carried out in case of coercion that resulted in neglect of passenger trains is a way to shift the other transport modes such as buses. Although normatively based on Article 88 of Law Number 23 Year 2007 on Railways in the event of Force Condition (coercion) railways organizers are not responsible.
