Abstrak :
The Indonesian Child Protection Commission (KPAI) is a state institution
responsible for safeguarding the rights of children in Indonesia in accordance
with applicable laws and regulations. KPAI is governed by Law No. 23 of 2002
concerning Child Protection, which was later amended by Law No. 35 of 2014. This regulation ensures that KPAI can carry out its duties and functions
ef ectively, aiming to create a safer and more child-friendly Indonesia. Sexual
abuse of children is an act that constitutes a criminal of ense, particularly in
relation to decency and morality, where the victim is under 18 years of age. The
forms of sexual violence being highlighted today are proof of the exploitation of
children by perpetrators who possess greater physical strength, carried out for
the sexual gratification of adults. The aim of this research is to examine the
ef ectiveness of the Indonesian Child Protection Commission (KPAI) in
providing legal protection for victims of child sexual abuse. This study adopts a
sociological juridical approach. The research specification is descriptive
qualitative, utilizing both primary and secondary data sources. Data collection
techniques include interviews, non-participant observation, and literature
review. Data processing uses methods of data reduction, data display, and
categorization, while data analysis is conducted qualitatively.The research
findings indicate that KPAI does not provide direct physical protection to
victims but instead conducts oversight. If legal protection for children is not
processed promptly or is delayed, KPAI intervenes to ensure that the legal
process proceeds swiftly, so that children can receive justice and protection.
