Abstrak :
Children are a group that requires special protection, including within the criminal
justice system. However, in certain cases, children may engage in unlawful acts,
including serious crimes such as murder. This research focuses on analyzing the
application of the elements of murder accompanied by other criminal acts, as well
as the judge’s considerations in delivering the verdict in Decision Number
8/Pid.Sus-Anak/2023/PN Kag. This study uses a normative juridical method with
case, statutory, and analytical approaches. The type of research is descriptive-
analytical, relying on secondary data sources analyzed qualitatively and
normatively through a literature study. The findings reveal that the application of
Article 339 of the Indonesian Criminal Code (KUHP) in Decision Number
8/Pid.Sus-Anak/2023/PN Kag is not entirely appropriate. Although the judge
considered the existence of other criminal acts following the murder, the legal facts
indicate that the murder was premeditated, making Article 340 of the Criminal
Code more applicable. Furthermore, the sentence imposed is relatively lenient
considering the severity and brutality of the act committed. This raises concerns
regarding inconsistencies with the principles of justice and legal certainty within
the juvenile criminal justice system.
