Abstrak :
The execution of restitution for victims of human trafficking criminal acts (TPPO)
is a crucial aspect of fulfilling victims' rights to compensation as determined by
court decisions. The implementation of restitution execution involves the role of the
Witness and Victim Protection Agency (LPSK) and the Prosecutor’s Office, which
face various challenges in its enforcement. Restitution is compensation provided to
victims by perpetrators and/or third parties to assist in their recovery from criminal
acts. This study aims to examine LPSK's assessment of restitution for TPPO victims
and identify the inhibiting and supporting factors in its execution in Bekasi Regency.
This research employs a socio-legal approach with a descriptive qualitative
specification. Data collection techniques include interviews, non-participant
observation, and literature studies. Findings from this study indicate that LPSK
considers the principle of fairness in determining the amount of restitution.
Additionally, several factors hinder and support the execution of restitution in
Bekasi Regency. LPSK assesses damages based on three categories: loss of wealth,
suffering, and medical and/or psychological treatment costs, considering fairness
and supporting evidence. The obstacles to restitution execution are legal structure,
legal substance, legal culture, and the perpetrators, while the supporting factors
include persuasive efforts towards perpetrators and asset confiscation. This study
recommends enhancing coordination between central and local governments,
strengthening LPSK human resources, and establishing clear regulations on asset
confiscation procedures and mandatory restitution payments by perpetrators.
