Abstrak :
Telemedicine is a remote health service that uses information and communication
technology. This research aims to analyze the synchronization of legal
responsibility arrangements and the form of responsibility of medical personnel
and health personnel as partners of digital health platforms in telemedicine services
in Indonesia. The type of research used is normative juridical with statutory,
analytical, and conceptual approach methods, with research specifications of
inventory of legislation (positive law), research on the level of legal
synchronization, and legal discovery in concreto. The data source used is
secondary data, with data collection methods through literature study. Data
processing is done through data reduction, data display, and data classification,
with data presentation using narrative text. Data analysis methods applied include
qualitative normative, grammatical interpretation, systematic interpretation, and
analogy interpretation. The results show that the regulation of legal responsibility
and the form of responsibility of medical personnel and health personnel as
partners of digital health platforms in telemedicine services in Indonesia has shown
vertical and horizontal synchronization based on the theories of Hans Kelsen and
Hans Nawiasky. This means that lower regulations have referred to higher
regulations, and higher regulations become the basis for the formation of lower
regulations. The forms of legal liability of medical personnel and health workers as
partners of digital health platforms in telemedicine services in Indonesia include
criminal, civil, and administrative liability.
