Abstrak :
The research examines the Legal Analysis of Insurance Companies in the
Management of Investment Insurance Policy Funds at PT. Kresna Life
Insurance due to a violation of the management of investment funds by
insurance companies. The research aims to analyze the management of
investment insurance policy funds and its legal consequences for PT. Kresna
Life Insurance. The research uses a normative juridical approach method with
analytical descriptive research specifications sourced from secondary data
with data collection methods, literature studies and normative juridical
analysis methods.
The results of the research by analyzing PT. AJK in the management of
investment insurance premium funds was found to have violated including
manipulation of financial statements, embezzlement of premium funds, and
provision of misleading information that harmed customers. The company
violated OJK regulations related to solvency, investment, and risk
management, including allocating funds to affiliated companies in excess of
the permitted limits. Failure in risk retention and transfer worsens the
company's financial condition. Based on the results of research and discussion
of PT. Kresna Life Insurance faces legal consequences due to a series of
violations in the management of investment insurance policy funds, including
administrative sanctions in the form of revocation of business licenses,
obligation to compensate aggrieved customers, and criminal penalties against
parties responsible for manipulation of financial statements, embezzlement of
premium funds, and other regulatory violations.
