Abstrak :
The evidence against the perpetrator of the crime of being an intermediary in the
sale and purchase of cannabis occurred when the defendant Andri Wahyu Prayugo
was about to get into the car after taking the goods packaged in a transparent plastic
clip with brown duct tape when suddenly approached by police officers from the
Banyumas Police Narcotics Unit for safekeeping. The defendant was an
intermediary in the sale and purchase of cannabis via Instagram DM through the
defendant's account “high_dimensions” between the seller and an account named
“perfect.art420 reborn x”. This study aims to determine the legal considerations of
judges in deciding criminal cases and proving the perpetrators of the crime of being
an intermediary in the sale and purchase of cannabis in the decision of the
Banyumas District Court 46/Pid.Sus/2024/PN.BMS. This research uses a normative
juridical approach method with prescriptive research specifications. The data used
is secondary data obtained by library method. The data presentation method is
presented in the form of narrative text in the form of descriptions arranged
systematically, logically and rationally. The data analysis method uses a qualitative
normative method. The results of the research in this decision are that the judge in
handing down the verdict was based on the facts in the trial and based on the
evidence presented, from this evidence the judge obtained the conviction that the
defendant was guilty. The legal considerations of the judge in handing down the
verdict have fulfilled the elements in Article 114 paragraph (1) of the Narcotics
Law.
