Abstrak :
Every human being wants a harmonious domestic life. However, the reality is that
domestic life does not always go according to your will because on the way to get
married you will face various problems that can trigger violence. Domestic
violence is included in one of the criminal acts. One form of domestic violence is
psychological violence which can result in psychological disorders in the victim.
The purpose of this study is to analyze the elements of psychological violence in
the domestic and find out the legal considerations of judges in the Banjarmasin
Military Court Decision Number 25-K/PM I-06/AL/VII/2023. This research uses
a normative juridical method with a legislative and case approach. The results
obtained from this study show that the perpetrator has been proven to have
committed psychological violence in the domestic but the judge sentenced the
prison sentence to a lighter sentence than the Public Prosecutor's demands. This
shows that psychological violence in the domestic has not been considered a
serious criminal offense. The conclusion in this study is that the judge overrides
philosophical and sociological factors in deciding the case so that the verdict
handed down is too light.
