Abstrak :
Health services are provided by a professional who in this case is medical
personnel and health workers, including medical personnel and health workers of
Indonesia citizens who graduated from abroad. This study aims to find out the
synchronization of the arrangement and form of responsibility of medical personnel
and health workers of Indonesia citizens who graduated abroad in health services.
This study uses a normative juridical approach method with the specification of
research on the inventory of laws and regulations (positive law), research on the
level of legal synchronization, and legal discovery in concreto. The type of data
used is secondary data collected by literature studies. The data analysis method in
this study uses a qualitative normative method. Based on the results of the study,
the regulation of the responsibilities of medical personnel and health workers of
Indonesia citizens in health services has shown a level of vertical synchronization.
This means that the lower regulations have been based on the higher regulations.
These regulations do not contradict each other. The form of legal responsibility of
medical personnel and health workers of Indonesia citizens who graduated abroad
in health services in the structure of Indonesia's laws and regulations, namely:
criminal law responsibility as stipulated in Article 308 paragraph (1) and Article
440 of Law Number 17 of 2023 concerning Health; civil law liability as stipulated
in Article 308 paragraph (2) of Law Number 17 of 2023 concerning Health;
Administrative responsibilities are regulated in Article 283, Article 306 and Article
313 paragraph (1) of Law Number 17 of 2023 concerning Health, Article 33 of the
Regulation of the Minister of Health Number 14 of 2022 concerning the Adaptation
Program for Specialist Doctors of Indonesia Citizens Graduated Abroad in Health
Service Facilities
