Abstrak :
The sea is often used as a disposal site for nuclear waste in the form of used
substances and materials as well as radioactive equipment in nuclear activities carried
out on land. The absence of regulations that specifically regulate the disposal of nuclear
waste from land to sea creates legal uncertainty in enforcing the protection and
prevention of marine environmental pollution regulated by international law. The legal
uncertainty occurred in the case of nuclear waste disposal carried out by TEPCO and
Japan at the Fukushima NPP in 2023.
The purpose of this study is to determine the regulation of the use of nuclear waste
disposal from land to sea according to international law and analyze the effectiveness of
the application of international law in terms of protection and prevention of marine
environmental pollution in the case of nuclear waste disposal from land to sea carried
out by TEPCO and Japan at the Fukushima NPP in 2023. This research uses a statutory
approach and case approach with descriptive analytical research specifications. The
data source used is secondary data. The data collection method is done by literature
study, the data obtained is presented with descriptive text, and the analysis method used
is normative qualitative.
Based on the research results, there is no regulation that specifically regulates
the disposal of nuclear waste from land to sea, so that the study, development, and
implementation must follow the provisions of applicable international law, namely
Articles 192, 194, 197, 207, and 210 of UNCLOS 1982, Articles 17 and 18 of the
Convention on Nuclear Safety 1994, Principle 1 of the 1972 Stockholm Declaration, and
Principle 2 of the 1992 Rio Declaration, as well as the principles of international
environmental law. The effectiveness of the application of international law regarding
the disposal of nuclear waste from land to sea can be seen from the fulfillment of a
country's obligations to the provisions contained in international law. In the case of
Fukushima NPP nuclear waste disposal in 2023, Japan has fulfilled the procedures
determined by the IAEA, but has not effectively implemented the provisions regarding the
protection and prevention of marine environmental pollution because there are several
international legal obligations that Japan has not fulfilled.
