Abstrak :
Based on the crime of participating in premeditated murder in Decision Number 798 /
PID. B/2022/PN JKT. SEL, the panel of judges sentenced the defendant to 1 year and
6 months in prison. In that case, the defendant was charged with Article 340 KUHP jo.
Article 55 paragraph (1) to 1 KUHP, but the defendant gets a light criminal sanction
because the defendant is a justice collaborator. This study aims to determine the
application of the elements of Article 340 KUHP jo. Article 55 paragraph (1) to 1
KUHP and the basis for the judge's legal consideration in determining the Defendant
as a Justice Collaborator and deciding the crime of participating in premeditated
murder in Decision Number 798/PID. B/2022/PN JKT. SEL. This research is a
normative juridical research, with a statutory approach and a case approach. The
specification of this study is descriptive analytical with secondary data sources
covering primary, secondary, and tertiary legal materials. The data collection method
is obtained by the library method with data processing methods in the form of data
refraction, data display and data categorization. The results of this study can be
concluded that the accused has fulfilled the elements of Article 340 KUHP jo. Article
55 paragraph (1) to 1 KUHP and has qualified as a justice collaborator.
