Abstrak :
In the settlement of an ordinary criminal case, public prosecutors usually do not
conduct case file splitting. However, in the case of illicit drugs trafficking
committed by Teddy Minahasa, public prosecutors of the West Jakarta District
Prosecutor General have conducted splitting. Hence, this research aims to
determine the basic rules and urgency, as well as the legal consequences of splitting
implementation on the case of illicit drugs trafficking committed by Teddy
Minahasa. This research uses normative juridical method with normative legal
research, approached by a statutory approach and a case approach. The specification
of this research is prescriptive using secondary data consisting of primary,
secondary, and tertiary law materials as data sources. The data collection method in
this research is done by means of library research and interviews, and presented in
narrative text. The results showed that the basic rules for the implementation of
splitting of Teddy Minahasa case in Indictment No. PDM-36/JKT.BRT/01/2023
refer to the provisions of Article 142 of the Criminal Procedure Code (KUHAP)
and Circular Letter General Prosecutors of Republic of Indonesia No. 9 of 2022.
The urgency of splitting the case is for the sake of dominus litis, to assist the public
prosecutor at the West Jakarta District Prosecutor General in adding evidence in the
form of witness testimony, facilitating the process of proof in the trial, perfecting
the evidence, and finding out who are the perpetrators who were involved in the
criminal act of illegal drug trafficking in the Teddy Minahasa case. The legal effect
of the splitting of this case is the examination of each evidence, including evidence
of witness testimony, experts, clues, letters, and defendants will be separated and
the three defendants will be able to become witnesses and defendants in other cases
in the disclosure of this case.
