Abstrak :
The Juvenile Criminal Justice System provides for a Diversion mechanism for
children in conflict with the law. The implementation of Diversion must consider
the category of the criminal offence, the age of the child, the support of the family
and community environment, and the results of Community Research from the
Correctional Centre. This study aims to analyse the effectiveness of Community
Research in determining Diversion agreements for children in conflict with the law
and what obstacles are faced in the implementation of Community Research as a
basis for determining Diversion agreements for children in conflict with the law at
the Class II Correctional Center Purwokerto. This research uses an empirical
juridical approach method with descriptive analytical research specifications. The
research location is at the Class II Correctional Centre Purwokerto. The data
sources used are primary data and secondary data. The data is processed by data
reduction, data categorisation, and data display and analysed by understanding
and assembling legal materials that have been collected and arranged
systematically and described in regular, coherent, and logical sentences, then
conclusions are drawn. The results showed that the effectiveness of Community
Research in determining the results of the Diversion agreement on children in
conflict with the law at the Class II Purwokerto Correctional Centre was quite
effective because most of the recommendations in the Community Research report
were followed as a result of the Diversion agreement. The obstacles faced by
Community Supervisors in determining the results of the Diversion agreement
include rules related to the time limit for completing Community Research, the
unevenness of integrated training in the juvenile criminal justice system for
Community Supervisors, uneven facilities for official vehicles and laptops or
computers, the community or victims who refuse to be processed for Diversion and
the culture of the community that still considers Diversion only benefits the
perpetrator and does not favour victims, and court hearings are still considered the
only place to seek justice.
