Abstrak :
This research examines the Decision of the Central Jakarta District Court
Number 650/Pdt.G/2021/PN Jkt.Pst regarding the act of default in the air
transportation cooperation agreement. The purpose of this research is to analyze
the form and legal consequences of default in the use of air transportation services
and the legal considerations of the judge regarding the act of default in the Decision
of the District Court Number 650/Pdt.G/2021/PN Jkt.Pst. The method used in this
research is the normative juridical approach with analytical perspective research
specifications. The data source used is secondary data, and data collection is done
through literature studies.
Based on the results of the research and discussion on Decision Number
650/Pdt.G/2021/PN Jkt.Pst regarding the domestic air transportation cooperation
agreement for the delivery of goods and documents within Indonesia through air
routes between CV. CITRA PERKASA MANDIRI (Plaintiff) and PT. KERTA GAYA
PUSAKA (Defendant), it is found that the form and legal consequences of default
in the air transportation agreement are that the Defendant did not fulfill its
contractual obligation to pay for the air transportation services. As a result, the
Defendant is sentenced to pay the principal debt for the air transportation services
immediately and in cash, as well as to pay the litigation costs. This is based on the
legal considerations of the judge, which establish that the Defendant defaulted due
to the presence of an error on the part of the Defendant. The legal considerations
of the judge in Decision Number 650/Pdt.G/2021/PN Jkt.Pst are in accordance with
Article 1238 of the Civil Code.
