Abstrak :
This research examines the Decision of the Bale Bandung District Court No. 135/Pdt.G/2022/PN Blb.This research examines about house rental agreements
which are used as collateral for mortgage rights. This research aims to analyze
the validity of the rental agreement entered into by both parties in accordance
with applicable law and to analyze the legal basis for the judge's cancellation of
the house rental agreement in case number 135/Pdt.G/2022/PN Blb. In this research using a normative juridical approach method, analytical
prescriptive research specifications. The data used is primary, secondary and
tertiary data with data collection using library research. Processing data by
reduction to summarize and explain facts systematically and presenting data
using narrative text. Analyzed normatively qualitatively. Based on the results of research and data analysis, the validity of the house
rental agreement does not meet the legal requirements of the agreement for the
purposes and conditions so it should be null and void by law. The judge's legal
considerations canceled the house rental agreement due to a breach of contract is
wrong, the judge should decide that the agreement is null and void and the parties
are returned to their original condition as before the agreement. The defendant is
sentenced to pay the remaining rent, compensation and pay court costs. Keywords: Rental Agreement, Mortgage Right, Null and Void
