Abstrak :
This study aims to determine the application of criminal offenses and legal
considerations for judges in imposing penalties in deciding cases in Decision
Number 12/Pid.Sus/2020/PN Kmn. This research uses a normative juridical type of
legal research, with a case approach method. The specification of this research is
prescriptive, with secondary data types and sources, and data analysis is carried
out descriptively deductively. The results of this study concluded that the
application of the crime of child abuse in Decision Number 12/Pid.Sus/2020/PN
Kmn can be reviewed from the fulfillment of the principle of legality and the
principle of guilt. The principle of legality is fulfilled because the defendant has
been legally and convincingly proven to have committed the crime of child abuse
as formulated in Article 82 Paragraph (1) of Indonesian Law Number 17 of 2016
concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of
2016 concerning the Second Amendment to Indonesian Law No. 23 of 2002
concerning Child Protection into Indonesian Law Jo Article 76E of Indonesian Law
No. 35 of 2014 concerning Amendments to Indonesian Law Number 23 of 2002
concerning Child Protection and there are no justification reasons. The judge has
carefully considered the criminal penalties stipulated in Article 82 Paragraph (1)
of Law of the Republic of Indonesia Number 17 of 2016, namely a minimum
imprisonment of 5 (five) years and a maximum of 15 (fifteen) years and a fine of up
to Rp5,000,000,000.00 (five billion rupees).
