Abstrak :
Disparity is the difference or distance between the judge's decisions
regarding the same case. The rise in cases of sexual harassment in Indonesia has
resulted in many different decisions in each court. This research aims to
determine the disparity in judges' decisions and determine the basis of judges'
legal considerations in deciding cases in Decisions Number 79/Pid.Sus/2023/PN
Unr and Decision Number 85/Pid.Sus/2023/PN Bbu. This research uses a
normative juridical type of legal research, with a statutory approach, a case
approach and a comparative approach. The specifications of this research are
prescriptive, with types and sources of secondary data consisting of primary legal
materials and secondary legal materials which are then collected through
literature study, and processed and analyzed using normative qualitative methods
presented in the form of narrative text. The results of this research show that the
causes of disparity in decisions include legal system factors, the absence of
sentencing guidelines, and judges' opinions. The judge's basic considerations in
deciding disparity cases are based on juridical considerations, sociological
considerations and philosophical considerations. Where the judge decided that in
decision No. 79/Pid.Sus/2023/PN Unr the defendant was sentenced to 12 years in
prison and in decision No. 85/Pid.Sus/2023/PN Bbu the defendant was sentenced
to prison for 15 years and 6 months.
