Abstrak :
A professional in this case is a medical worker and health worker, including
medical workers and health workers of foreign citizens who graduated abroad.
This study aims to determine the synchronization of regulations and forms of
responsibility of medical personnel and health workers of foreign nationals who
graduated abroad in health services. This research used a normative juridical
approach method with the specification of research on inventory of legislation
(positive law), research on the level of legal synchronization, and legal discovery
in concreto. The type of data used in this research is secondary data and the data
collection method is done by literature study. The data analysis method used in
this research is qualitative normative method. Based on the results of the
research, the regulation of the responsibilities of foreign medical personnel and
health workers in health services is clearly regulated in the Minister of Health
Regulation Number 6 of 2023 concerning the Empowerment of Foreign Health
Workers and Law Number 17 of 2023 concerning Health has shown the level of
vertical synchronization. This means that lower regulations have been based on
higher regulations. These regulations also do not contradict each other. The form
of responsibility of medical personnel and foreign-graduate health workers in
health services in the structure of Indonesian legislation, namely: criminal law
responsibility as stated in Article 308 paragraph (1) and Article 440 paragraphs
(1) and (2) of Law Number 17 of 2023 concerning Health; civil law responsibility
as stated in Article 308 paragraph (2) of Law Number 17 of 2023 concerning
Health; administrative law responsibility as stated in Article 283, Article 306, and
Article 313 of Law Number 17 of 2023 concerning Health and Article 47 of the
Regulation of the Minister of Health of the Republic of Indonesia Number 6 of
2023 concerning the Utilization of Foreign Health Workers.
