Abstrak :
The rapid development of technology has resulted in the emergence of new
payment systems, starting from Electronic Money to Cryptocurrencies or
commonly called cryptocurrencies, one of which is Bitcoin. The existence of
Bitcoin on the one hand is very useful as an investment tool, but on the other hand
it is very dangerous when used as a tool for a criminal offence. Bitcoin uses a
payment network system using a peer-to-peer (P2P) system, Bitcoin is often used
on several illegal sites and accessibility that can only be accessed through the
Dark Web. This research aims to find out the use of Bitcoin as a means of
purchasing Narcotics transactions and also aims to find out the perceptive of
Criminal Law on Bitcoin which is used as a transaction tool for Criminal Acts.
The research method used is a normative juridical approach. The data used is
secondary data with literature study data collection. Presented in the form of
narrative text with qualitative analysis method. The results of this study concluded
that Bitcoin can be used as a means of payment by accessing the Dark Web which
can only be accessed using The Onion Router (TOR), this is very likely to be used
as a transaction tool for a criminal offence and until now practically only Law
Number 7 of 2011 concerning Currency which only discusses legal currency. If
you look at Bank Indonesia Regulation Number 18/40/PBI/2016 and PBI Number
19/12/2017, it only regulates administrative sanctions, not criminal sanctions.
