Abstrak :
Society is a social creature that cannot live alone. This is seen from the attitudes
and behavior towards the environment in which he lives. However, it is not
uncommon for there to be differences of opinion between one another. In married
life there are bound to be differences, if these debates cannot be mediated it can
cause a breakdown in the household. One way to reconcile disputing parties is
mediation. Mediation can be carried out outside the court or inside the court. This
research was conducted to find out how effective Supreme Court Regulation No. 1
of 2016 concerning Mediation Procedures in Court and to find out what the role of
the mediator is in leading mediation and seeking peace between the disputing
parties which is implemented in the Banyumas Religious Court. This research uses
a research method with an empirical juridical approach, where the research
specifications are analytical descriptive. The data sources used are secondary data
and primary data. Based on research results based on Supreme Court Regulation
No. 1 of 2016 concerning Mediation Procedures in Courts that the implementation
of mediation in divorce lawsuit cases has not been fully effective, this is based on
the number of unsuccessful mediations being greater than the number of successful
mediations. Several factors that influence the failure of mediation include the small
number of certified mediators at the Banyumas Religious Court.
