Abstrak :
Traffic accidents are acts that are punishable by imprisonment. However,
in practice, not all traffic accidents are resolved through judicial channels. Here
the role of the investigator is to reveal the chronology of the incident, find the cause
of the incident, determine whether the case will continue or will be resolved through
restorative justice. This study aims to analyze the regulation and legal basis of
Restorative Justice and the role of investigators in handling criminal traffic
accidents at the Indramayu Police Traffic Unit, factors that influence the role of
investigators in handling criminal traffic accidents at the Indramayu Police Traffic
Unit as well as the role of investigators. The approach method used is juridical
sociological, analytical descriptive research specifications. The data used are
primary data and secondary data. The data collection method was carried out by
interviewing at Indramayu Police Station which was presented in narrative text.
The data analysis method uses qualitative analysis. The results showed that the
regulation and legal basis used was Police Regulation Number 8 of 2021
concerning Handling Crimes Based on Restorative Justice. The factors that
influence the role of investigators in handling traffic accident crimes at the
Indramayu Police Traffic Unit are the legal factors themselves (Legislation), law
enforcement factors, facilities and infrastructure factors. Suggestions: 1) increase
the socialization of understanding to the public about the concept of Restorative
Justice so that people understand well the resolution of legal cases that occur or
are experienced. 2) The community is expected in the future to be more cooperative
with legal problems experienced so that the applicable legal system can run
optimally.
