Abstrak :
Cases of sexual violence experienced by women and children put victims in an unsafe position
both at home and outside the home. Women and children in Banyumas Regency are no
exception, as they are vulnerable to becoming objects of sexual violence. Article 6 paragraph
1 of Law No. 31/2014 stipulates that victims of sexual violence are entitled to medical
assistance and psychosocial and psychological rehabilitation assistance. This study aims to
determine the effectiveness of the recovery of victims of sexual violence based on Law No. 31
of 2014 in the jurisdiction of the Banyumas Police and to determine the obstacles experienced
in recovering victims of sexual violence in the jurisdiction of the Banyumas Police despite the
existence of Law No. 31 of 2014. This research uses an empirical juridical approach method
with descriptive analytical research specifications. The research location is at the Women and
Children Service Unit (PPA Unit) of the Banyumas Police. The method of determining
informants in this study using purposive sampling technique. The data sources used are
primary data and secondary data. The results showed that the recovery of victims of sexual
violence in the jurisdiction of Polresta Banyumas is still less effective due to the difference
between law in action and law in book/theory. The existing obstacles are influenced by three
aspects, namely the legal structure aspect where the lack of distribution of the Witness and
Victim Protection Agency (LPSK) makes it difficult for victims in the Banyumas Police
jurisdiction to obtain restitution, legal substance, where there is no regulation regarding
certain mechanisms to make it easier for victims domiciled in the Banyumas Police jurisdiction
to obtain restitution from the Witness and Victim Protection Agency (LPSK) in Semarang, and
legal culture, where there is a bad stigma in the community who thinks that if a victim of sexual
violence is a disgrace in the community.
