Abstrak :
Consumer protection is all efforts that guarantee legal certainty to provide
protection to consumers. This research was conducted on Ruling Number
930/Pid.Sus/2021/PN.BDG regarding the actions of business actors who traded
processed food goods and household needs, used Alfamart flooded which were
damaged and defective by way of a sale as if the goods had no hidden defects. .
The approach method used in this study is Normative Juridical with
descriptive analytical research specifications. The data sources used in this research
are primary legal materials, secondary legal materials and tertiary legal materials.
The data obtained will be analyzed using qualitative normative data analysis
methods and presented in the form of narrative text which is arranged
systematically, logically, and rationally.
Based on the results of the research conducted, it was found that business
actors have been responsible as stipulated in Article 62 paragraph (2) in conjunction
with Article 11 letter b of Law Number 8 of 1999 concerning Consumer Protection,
this is stated in the judge's decision contained in the Bandung District Court
Decision Number 930/Pid.Sus/2021/PN.Bdg. The legal consequence for the actions
of business actors who have traded ex-flooded goods with hidden defects is that the
business actor is found guilty of violating the provisions contained in Article 62
paragraph (2) in conjunction with Article 11 letter b of Law Number 8 of 1999
concerning Consumer Protection, so that business actors are given criminal
sanctions in the form of imprisonment for 8 (eight) months.
