Abstrak :
Human trafficking is an organized and transnational crime so that it
can be categorized as a transnational organized crime (a crime that causes
transnational damage). The network of traffickers is part of a neatly organized
and sophisticated network. Based on data from the Cilacap Police Department,
from 2019 to October 2022, there were 1,142 victims of the human trafficking.
The problems discussed in this study are (1) how effective is the eradication
human trafficking within the jurisdiction of the Cilacap Police Department? (2)
What are the obstacles faced in eradicating human trafficking within the
jurisdiction of the Cilacap Police Department? The purpose of this study is to
analyze the effectiveness and obstacles to eradicating human trafficking. The
research in this thesis uses a sociological juridical approach, a qualitative
research type. The research location is the Cilacap Police Department. Primary
data collection by interviews and secondary data by literature study. Data is
processed by data reduction techniques, data presentation, and drawing
conclusions. Presentation of data in the form of descriptive narrative and
presriptive. Data analysis uses inductive thinking logic. The theoretical
framework used is Donald J. Black's Theory of Legal Effectiveness to determine
the effectiveness of eradicating human trafficking and the Legal System Theory
from Lawrence M. Friedman to determine the obstacles in eradicating human
trafficking.
This study found that the eradication of human trafficking in persons
within the jurisdiction of the Cilacap Police Department has not been effective.
Factors constraining the effectiveness of eradicating human trafficking within
the jurisdiction of the Cilacap Police Department include 3 (three) aspects,
namely legal structure, legal substance, and legal culture. Obstacles to the legal
structure in the form of a lack of Cilacap Police Department personnel, ideally
number of personnel is 1,670 (one thousand six hundred and seventy) people,
but there are only 993 (nine hundred and ninety three) active personnel. There
are no obstacles from the legal structure because according to the Law of the
Republic of Indonesia Number 21 of 2007 concerning The Eradication of
Human Trafficking (i) has detailed and more clearly the formulation of human
trafficking, (ii) provides clear details regarding the process, method and
objectives in a series of actions to be classified as a human trafficking, (iii)
provides punishment that is quite severe for the perpetrators of human
trafficking, and (iv) it also regulates public protection against the crime of
human trafficking. Obstacles from the legal culture in the form of habits,
opinions, ways of thinking, and ways of acting from members of the public
regarding migrant workers are still a supporting ecosystem for the continued
practice of human trafficking in Cilacap Police Department Jurisdiction.
