Abstrak :
Procurement of land for the construction of the Yogyakarta International Airport
resulted in the provision of Compensation to the entitled party. The provision of
Compensation can be given directly to the authorized party after obtaining an
agreement regarding the amount and form of Compensation in deliberations. At the
same time, they are giving Compensation indirectly if the consideration for the
granting of Compensation does not reach an agreement due to a specific condition so
that the agency that needs land, in this case, PT Angkasa Pura I, entrusts compensation
money to the district court by way of custody compensation. The purpose of this
research is to find out the procedure for custody compensation and execution related
to custody compensation money at the Wates District Court and the factors that
influence those entitled to land who have not received Compensation. This study uses
a sociological juridical approach with descriptive-analytical research specifications.
The types and sources of legal material in this study were derived from primary and
secondary data using purposive sampling. The data obtained were analyzed using
qualitative analysis methods. The study results show that the custody compensation
procedure is regulated in Supreme Court Regulation 2 of 2021 Jo. Supreme Court
Regulation Number 3 of 2016 concerning procedures for filing objections and
depositing Compensation to the district court and the factors causing the entitled party
to not receive Compensation due to problems with community factors, namely
ownership disputes, including inheritance disputes, buying and selling underhanded.
After the ownership dispute is decided by the court and determined as the owner of the
land, the land owner can apply for execution to withdraw the custody compensation
money.
