Abstrak :
Disputes between outsourcing parties often occur due to implementation
that is not in accordance with applicable laws and regulations, causing non –
fulfillment of rights and obligations between the parties. This study aims to
analyze the legal protection of outsourcing workers as well as the implications of
the transition of specific time work agreement into indefinite work agreement in
the decision of the Pangkal Pinang District Court Number 40/Pdt.Sus-
PHI/2021/PN.Pgp.
The research method used is normative juridical with descriptive-
analytical research specifications. The data used are secondary data sourced
from library studies and legislation. Data were processed and analyzed by
qualitative normative methods.
The results showed that Law Number 11 year 2020 on Job Creation has
basically guaranteed legal protection for outsourced workers. The transition of
specific time work agreement into indefinite work agreement has implications for
related parties. For workers, the implication is null and void, so specific time
work agreement become indefinite work agreement . As for employers, the
implication is that employers must pay the normative rights of outsourcing
workers in accordance with Article 81 number 44 of Law Number 11 year 2020
concerning job.
