Abstrak :
This study aims to determine the synchronization of arrangements and forms of legal
protection of HIV and AIDS patients in public health services. The research method
used is normative juridical with statute approach, an analytical approach, and a
conceptual approach. The research specification used are inventory of laws and
regulations, legal synchronization, and legal findings in concreto. Analysis method
used in this study are normative qualitative, content analysis, and comparative
analysis. Based on this study, it shows that the regulations for legal protection of HIV
and AIDS patients in public health services in the structure of Indonesian legislation
has shown the level of vertical synchronization. This means that the Indonesian
regulations with lower level has been guided by the regulations with higher level and
vice versa. Forms of legal protection for HIV and AIDS patients are: guarantee of
getting access to public health services; guarantee of health promotions and free from
any form of discriminations; guarantee of the medicine and the availability of the
medicine; guarantee of getting treatments and supports; guarantee of counseling and
treatment for pregnant women with HIV and AIDS; guarantee of treatment for the baby
birthed by a woman with HIV and AIDS; guarantee of rehabilitation; guarantee of
funded medical treatments for HIV and AIDS patients who can afford the treatments;
guarantee of getting every rights of patients in the hospitals; guarantee of their
medical conditions to be kept as secret; and guarantee of demand compensation from
the hospital.
